Effective 1st January 2021, all foreign nationals including from the EU need sponsorship from an employer to work in the UK. The employers need a Sponsor License issued by the UK Home Office to provide sponsorship certificates to sponsor foreign workers.
Organisations operating in IT, Engineering, Health Care industries or any industry which needs skilled workers for the growth and expansion of their business which require to hire foreign workers need the sponsor licence. Sponsoring a skilled worker helps you to retain staff for longer duration providing certainty and right skills in your organisation.
Once your organisation acquires a Sponsor License, you’re officially permitted to employ skilled overseas nationals for job positions. You will issue a Certificate of Sponsorship for these employees, which legitimises their employment as foreign workers.
Abiding by this law is mandatory for organisations with foreign workers to avoid any penalties from the UK Home Office.
To be eligible, you must have a business presence and operate by the law in the UK. No matter if it’s a start up or established business.
If you have multiple branches in the UK, based on your current position, you can choose to have one license for all of them or a separate one for each.
Throughout the procedure, the Home Office will assess if the organisation is genuine and ensure you have a system to pay the skilled worker fairly, as specified under the Home Office guidelines.
To apply for the license, you must submit an application and a cover letter explaining your business background, an online application form, and a minimum of 4 documents that support your trading or operations in the UK. This application’s submission means you’re agreeing to all responsibilities and duties of Sponsor license holder. The Home Office can also ask you to provide information about your HR processes to see if the hiring and compliance processes fit the sponsor license requirements.
