UK Indefinite Leave to Remain (ILR) – Permanent Residence in the UK

Indefinite Leave to Remain (ILR), also known as Permanent Residence, grants individuals the right to live and work in the UK free from immigration restrictions. The qualification criteria for ILR vary depending on the type of visa status you have held in the UK.

Minimum Period of Continuous Stay in the UK

The following table provides a guide to the minimum period of stay within the UK required to qualify for Indefinite Leave to Remain. You can combine different visa types to meet the qualifying period. For instance, you might have entered the UK with a Tier 2 Work Permit and then switched to a Tier 1 General Visa. Both periods count toward the qualifying period.

Indefinite Leave to Remain removes all immigration-based restrictions in the UK. During the qualifying period, you should aim not to be outside the UK for more than 90 days in any 12-month period. However, exceptions exist for periods outside the UK related to UK employment or specific visa types that allow for longer absences.

Economic Activity Requirements

In addition to meeting the minimum period of stay, certain visa categories have additional economic activity requirements when applying for Indefinite Leave to Remain:

  • Tier 1 General visa holders must demonstrate they meet the points threshold similar to their visa extension requirements.
  • Tier 2 Visa holders must prove they have earned at least the salary specified in their most recent Tier 2 Visa application.

Other Requirements for Indefinite Leave to Remain

All ILR applicants must:

  • Pass the Knowledge of Life in the UK Test;
  • Be free from any unspent convictions under the Criminality section.

After one year of holding Permanent Residence (ILR), you can apply for British Citizenship.

Indefinite Leave to Remain Application Process

Applications for Indefinite Leave to Remain submitted by post can take up to 6 months to process, and your passport will be retained during this time. If you need a faster decision, you can book an appointment to expedite your application.

Note: Applicants who have already been on the old income threshold of £18,600 will remain on that threshold until they qualify for Indefinite Leave to Remain (ILR).
